HHS delays Stage 2 meaningful use for EHRs

The Department of Health and Human Services (HHS) Secretary Kathleen Sebelius recently announced that HHS will delay for one year the start of Stage 2 meaningful use for electronic health records (EHRs). This delay should help physicians and hospitals as it will allow more time for development, testing and implementation of EHRs. Also, it will allow physicians and other eligible providers (EPs) more opportunity to focus on Stage 1 requirements before shifting focus to new Stage 2 requirements.
 
EPs who have met the definition of Stage 1 meaningful use by October 3 (90 days prior to the end of calendar year 2011) must attest to meeting meaningful use by February 29, 2012 to qualify for 2011 incentive payments. Note that EHR incentive payments for EPs are based on a calendar year rather than a fiscal year, and hospital-based EPs do not qualify for Medicare EHR incentive payments.

Physicians are eligible for either Medicare incentive payments (up to $44,000) or Medicaid incentive payments (up to $63,750), not both. However, physicians will still be subject to Medicare payment penalties if they are not meaningful users in CY 2015 and beyond.

Physician fee schedule final rule for 2012

The American Hospital Association (AHA) has released a Regulatory Advisory summarizing the Center for Medicare & Medicaid Service’s physician fee schedule (PFS) final rule for CY 2012 with changes to the Medicare and other Medicare Part B payment policies. Released November 1, the rule also discusses changes to the physician quality reporting system, the eRx and EHR incentive programs, the physician resource-use feedback program and the VBP modifier. The rule’s changes generally take effect January 1, 2012.
